General Terms and Conditions for Training and Training Workshops

1. General provisions and definitions

  1. These general terms and conditions apply to House of Řezč s.r.o., Company ID: 04673212, with its registered office in Gorkého 51/1, Brno-město, Brno, postal code 602 00, registered in the Commercial Register maintained by the Regional Court in Brno, section C, file 91358.
  2. These General Terms and Conditions govern the mutual rights and obligations between the Seller and the Buyer arising under the Purchase Agreement (hereinafter referred to as”Purchase contract“) concluded between the seller and a third party (hereinafter referred to as “Buyer“) through the Seller's online store. The online store is operated by the Seller on the website located at www.houseofrezac.com.
  3. The buyer is understood to be an entrepreneur or a consumer.
  4. Buyer — consumer means any person who enters into a contract with the seller or otherwise acts with him outside the scope of his business activity or outside the scope of the independent exercise of his profession.
  5. Buyer — Entrepreneur means a person who independently pursues, on his own account and responsibility, a gainful activity by trade or similar means with the intention of doing so consistently for the purpose of making a profit. In addition, any person who enters into contracts relating to his own business, production or similar activities or in the exercise of his or her profession, or any person acting on behalf of or on behalf of the entrepreneur, shall also be regarded as an entrepreneur within the meaning of these General Business Terms and Conditions.
  6. Subject of purchase for the purposes of these General Terms and Conditions means research training (hereinafter referred to as'trainings“). The content and scope of the training, or accompanying services, the amount of the price including VAT related to the training can be found in the online shop directly next to this training.
  7. By sending the order to the Seller, the Buyer confirms that he has familiarized himself with the content of the General Terms and Conditions and considers their content to be clear and understandable. These General Terms and Conditions are an integral part of the Purchase Agreement.
  8. Provisions that differ from the general terms and conditions may be negotiated in the purchase contract. The derogations in the purchase contract take precedence over the provisions of the General Terms and Conditions.
  9. The provisions of the General Terms and Conditions are drawn up in the Czech language and the purchase contract is also concluded in the Czech language.
  10. The Seller may change or supplement the text of the General Terms and Conditions.
  11. NOZZLE means Act No. 89/2012 Coll., the Civil Code.

2. Conclusion of the purchase contract

  1. The buyer has the opportunity to order training by sending an electronic order to the seller. The Buyer makes an electronic order by placing on the website www.houseofrezac.com mark the training on the order form and fill in all the data on the form provided. Before submitting a binding order, the Buyer has the opportunity to check the information specified in the order and correct it if necessary. By submitting the order, the buyer accepts these terms and conditions and the price for the training.
  2. An order sent to the seller is considered a draft contract. The conclusion of the purchase contract occurs at the moment of confirmation of receipt of the order by the seller, which the seller sends to the buyer's e-mail specified in the order. Included in the order is a confirmation from the buyer that he has familiarized himself with these terms and conditions. Upon receipt of payment, the seller will send to the buyer's e-mail address specified in the order confirmation of the training reservation.

3. Payment method, delivery method, delivery cost

  1. Orders can only be paid by bank transfer on the basis of an advance invoice issued by the seller upon receipt of the order and sent to the buyer's e-mail address specified in the order. The invoice due date is indicated directly on the invoice. If the buyer does not pay this invoice properly and on time, the order is canceled. In this case, the buyer may have the opportunity to order training by creating a new order. The Buyer will be informed about the status of the order execution by e-mail to the e-mail address specified in the order.
  2. Training takes place in the cities selected by the buyer in the order form. The cost of the trip to the training and return of all participants, which the Buyer filled in the order and sent to the training, is borne by the Buyer himself.
  3. In the event that the Buyer or the trainee reported by him in the order is unable to attend the training for important reasons, the Buyer may contact Customer Care by e-mail at skoleni@houseofrezac.com.
  4. The Seller reserves the right to change the date or venue of the training. In this case, the seller informs the buyer by e-mail to the e-mail address specified in the order. The buyer has the right to demand the return of the entire amount paid back or to choose a different date and place of training. The Buyer is obliged to inform the Seller about the choice made by e-mail to the e-mail address skoleni@houseofrezac.com.

4. Copyright

  1. Purchaser and trainee (hereinafter referred to as”user“) acknowledges that the material outputs of the training are a work within the meaning of the Copyright Act, and as such are subject to the protection of this Act. The Seller hereby grants the User a non-exclusive, temporally and territorially unlimited license to the outputs, with the understanding that the User in particular is not entitled to use such outputs other than for his personal use, i.e. may not further distribute, sell, rent, communicate to the public or otherwise provide them to third parties. The price of the license is included in the price of the training.
  2. The User further acknowledges that in any use of the Website as well as the downloaded works, he is obliged to respect and comply with the applicable legislation, in particular the Copyright Act and is obliged to avoid any encroachment on copyright and intellectual property rights.
  3. The Buyer acknowledges that for infringement of copyright or other rights protected by law, he may be penalized according to the applicable legislation.

5. Termination of the contract

  1. Buyer — Consumer has the right to withdraw from the purchase contract for training concluded by means of distance communication within a period of 14 days. The withdrawal period runs from the confirmation of the order. Buyer - Consumer must inform the Seller of their decision to withdraw from the contract by e-mail notification of withdrawal from the contract to the address skoleni@houseofrezac.com. Buyer can use sample email for withdrawal listed at the end of these Terms and Conditions. If the Buyer-Consumer withdraws from the contract, the Seller shall send the received funds to the designated bank account, no later than 14 days after the receipt of the withdrawal to the Seller.
  2. Buyer — Consumer does not have the right to withdraw from the contract if the training took place before the expiry of the 14-day withdrawal period, to which the buyer — consumer agrees (§ 1837 (a) of the NOZ).
  3. Buyer — Entrepreneur has the right to withdraw from the purchase contract for training concluded by means of distance communication by sending a withdrawal from the contract to the address skoleni@houseofrezac.com. If the seller withdraws more than 7 days before the training in question, the buyer undertakes to pay the seller a contractual penalty (cancellation fee) in the amount of 20% of the price of the training; if the seller withdraws less than 7 days before the training in question, the buyer undertakes to pay the seller a contractual penalty (cancellation fee) in the amount of 100% of the price of the training.

6. Complaints

  1. The buyer has the right to familiarize himself with the focus and quality of the seller's consulting activity before ordering training, among other things, on the seller's website www.houseofrezac.com. For this reason, after attending the training, the Buyer is not entitled to demand a refund of the payment already paid for the training, on the grounds that it does not suit him from a subjective point of view.
  2. If possible, the Buyer may raise a claim for a reason other than that specified in point 1 of this article by sending an e-mail to the e-mail address skoleni@houseofrezac.com. The e-mail must contain: the number of the advance invoice or variable symbol, the date and place of the training to which the complaint relates, a description of the detected defects and their manifestations.
  3. The seller will notify the buyer of the receipt of the claim no later than 3 working days after its delivery by e-mail, unless he agrees otherwise with the buyer.
  4. The complaint will be processed without undue delay, no later than 30 days from the date of application of the claim, unless the seller and the buyer agree otherwise.

7. Communication from the seller to the buyer before the conclusion of the contract

  1. By submitting the order, the Buyer confirms that, in accordance with § 1810 and the following NOZ, he received from the seller before the conclusion of the contract clear and understandable information required by law, namely:
  2. the identity of the seller, or telephone number or e-mail delivery address or other contact information,
  3. designation of training and description of its main characteristics,
  4. the price of the training and, where applicable, the method of its calculation, including all taxes and fees,
  5. the method of payment and the method of delivery,
  6. the cost of attending the training and, where these costs cannot be determined in advance, an indication that they may be charged additionally,
  7. data on the rights arising from defective performance, as well as the rights under warranty and other conditions for the exercise of these rights.
  8. By submitting the order, the Buyer further confirms that, within the meaning of § 1820 and the following NOZ, he received from the Buyer prior to the conclusion of the contract in a clear and understandable manner the information required by law, namely:
  9. the cost of means of long-distance communication, if different from the basic rate,
  10. details of any obligation to pay a deposit or similar payment, if required,
  11. the conditions, time limit and procedures for exercising the right of withdrawal, if it can be exercised, as well as the withdrawal form;
  12. an indication of the existence, manner and conditions of out-of-court handling of consumer complaints, including whether a complaint can be addressed to a supervisory authority or a state supervisory authority.

9th. Final provisions

  1. The relations between the seller and the buyer are governed by the legislation of the Czech Republic. Any disputes will be decided by the competent court. With a possible complaint, the buyer can contact the supervisory authority or state supervision.
  2. These Terms and Conditions are displayed on the Seller's website and thus enable them to be archived and reproduced by the Buyer.
  3. For both the Seller and the Buyer, the text of the Terms and Conditions listed on the Seller's website on the day the Buyer makes the order is binding.
  4. If the seller and the consumer do not agree on an acceptable compromise in the event of a dispute, the consumer may contact the Czech Trade Inspectorate with a proposal to initiate an out-of-court settlement of the dispute. The details of the proposal, the description of the course of the negotiations and other information regarding the out-of-court settlement of the dispute can be found by the consumer on the website of the consumer www.coi.cz.

These General Terms and Conditions shall enter into force on 1 May 2020.
